Below are a few commonly asked questions...
1. Can I recover a sum of money owed, together with costs and interest?
This is possible but will depend, among other things, on the terms of any contract under which the money is owed, the amount
owed and the method of recovery you use. In order to act in such matter, we would require full details of the debt and
copies of any paperwork. We do offer a fixed fee debt collection service, currently for letters before action and
preparation of statutory demands only.
2. Can I remove a problem tenant from my property and recover arrears?
Depending on the circumstances and the agreement there may be a number solutions to remove the tenant and/or recover the
arrears quickly.
3. I have had an accident at work. Can I obtain compensation?
You potentially have a claim in such circumstances and have three years from the date of the accident to commence proceedings
against your employer. We can investigate the merits of your potential claim and advise you accordingly. However,
Pellys LLP do not offer a conditional fee service for such matters.
4. I have been left out of a Will and want to know if I can bring a claim against the Estate
This is possible depending on, among other things, your age and relationship to the deceased. However, any claim under the
Inheritance (Provision for Family and Dependants) Act 1975 must be issued within six months of the Grant of Probate.
5. Persons unknown to me have set up camp on my land without permission and I need them removed quickly. Can this be done?
There are strict court procedures which need to be followed, but we can deal with and obtain a court order to remove
unauthorised persons on your behalf.
6. Are there any alternatives to issuing court proceedings to resolve a dispute?
There are various types of alternative dispute resolution (known as "ADR") which can be used either instead of or as a precursor
to litigation. These include arbitration, mediation, expert determination and adjudication. We can advise you on the various
methods available for resolving disputes and assist you in choosing the correct method for your circumstances.
